Wizard Massage Terms and Conditions

1.1 Wizard Home Services Pte. Ltd. (“Wizard”) operates and manages an online booking platform at www.wizard.com.sg (the “Website”) through which a customer can book a massage service appointment by submitting a Booking Request. Once a Booking Request has been submitted, Wizard then matches the most suitable Massage Service Provider from its database (the “Database”). Once Booked Service has been completed, Wizard issues an invoice on behalf of the Massage Service Provider to the customer and engages the Payment Agent to collect payment of the Booked Service Fee from the customer. Once collected, the Payment Agent disburses the Booked Service Fee to the Massage Service Provider in accordance to the Independent Contractor Agreement.

1.2. Wizard operates the Website as an independent third party facilitator for the Massage Services and provides you with the platform to purchase the Massage Services.

1.3. Wizard is not an agent or broker for you or the Massage Service Provider. You enter into any transaction with a Massage Service Provider entirely at your own risk.

1.4. The Massage Service Providers are independent vendors, and are not employed by nor an agent of Wizard.

1.5. Wizard uses its best efforts to monitor the Massage Services offered by a Massage Service Provider. However, as Massage Service Providers act as independent contractors, Wizard does not make any representations relating to the safety, quality, condition, or description of the Massage Services provided by the Massage Service Provider. Any issues regarding safety, quality, condition or description of the Massage Services should be notified to Wizard, who will then pass the issue onto the Massage Service Provider designated to your Booking Request.

1.6. All bookings are subject to the Massage Service Provider’s availability.

2. WARRANTY

The 90-day warranty period given by Wizard does not apply to Massage Services.

3. SEXUAL SERVICES

3.1. Our Massage Service Providers are trained and certified to provide proper massages. We will not entertain any request to provide sexual services or acts of indecency.

3.2. The Client shall not engage the Massage Service Provider in any sexual activity or act of indecency. The Client shall not himself or herself partake in such acts during the course of the service.

3.3. “Sexual service/activity” includes sexual intercourse, oral sex, and masturbation. “Act of indecency” includes any touching of another person’s private parts.

4. LIMITATION OF LIABILITY

4.1. You hereby acknowledge that you are aware of the benefits and risks associated with the massage services arranged through Wizard and/or Wizard platform and give your consent.

4.2. To the fullest extent permitted by applicable law, Wizard, Wizard platform and their respective partners, agents, employees and officers shall not be liable for any loss or damage to property or in respect of any bodily injuries, illness or death of you, and/or other persons including third parties, howsoever caused, aggravated or incurred arising out of or in any way connected with but not limited to any behaviour of you, the massage services arranged through Wizard and/or Wizard platform.

4.3. You hereby acknowledge that you understand and voluntarily accept the risks of injury involved in the massage services arranged through Wizard and/or Wizard platform. To the fullest extent permitted by applicable laws, you hereby agree Wizard and/or Wizard platform shall not be liable in contract, tort (including without limitation negligence), pre-contract or other representations or otherwise out of or in connection with your participation in the massage services arranged through Wizard and/or usage of the Wizard platform for any claims, demands, damages, economic losses (including without limitation, loss of revenues, profits, contracts, business or anticipated savings), loss of good will or reputation, or special or indirect consequential losses in any case. You further agree not to hold Wizard and/or Wizard platform liable for any wilful act or omission, default, fraud or negligence of any other person or guest or third party related to the massage services arranged through Wizard and/or Wizard platform.

4.4. You hereby agree to defend, fully indemnify on demand and hold harmless Wizard and/or Wizard platform from and against all liabilities, claims, expenses, damages and losses including legal fees (on an indemnity basis) Wizard and/or Wizard platform may suffer arising from any breach of these terms and conditions by you, or in connection with any act, omission, default, negligence or conduct of you, or in connection with any other liabilities arising out of your participation of the massage services arranged through Wizard and/or Wizard platform under this Agreement. This obligation to indemnify Wizard and/or Wizard platform shall survive the termination of this Agreement.

5. YOUR APPOINTMENT TIME

5.1. Your appointment is very important to us and it is reserved especially for you. We recommend that you be physically present at the service location at the appointed time. Arriving late will limit the time of your treatment.

5.2. If the Massage Service Provider arrives at the service location and you are not in, we will attempt to reach out to you via telephone:

(a) If we are unable to reach you, the Massage Service Provider will wait for 15 minutes at the service location after which we will treat your

Booking as cancelled – see our Cancellation Policy below.

(b) If we are able to reach you, the Massage Service Provider will give you a grace period of 15 minutes after which the treatment time will start

regardless of whether you are physically present or not. Your treatment will end at its new designated time so that we may remain on time for

all other appointments.

6. RESCHEDULE

6.1. You may reschedule your appointment made if it is carried out 24 hours or more prior to the confirmed appointment date and time at no charge to you.

6.2. If you reschedule your appointment made between 24 hours and 4 hours prior to the confirmed appointment date and time you shall be charged 20% of the fee already paid by you.

6.3. If you reschedule your appointment made less than 4 hours prior to the confirmed appointment date and time you shall be charged 50% of the fee already paid by you.

7. CANCELLATION

7.1. You shall be charged 100% of the fee already paid by you for any cancellation made less than 24 hours prior to the confirmed appointment date and time.

7.2. You shall be charged 50% of the fee already paid by you for any cancellation made more than 24 hours prior to the confirmed appointment date and time.

7.3. All refunds shall be made within 14 working days.

8. TIME EXTENSION

Where the need/desire arises for The Wizard Therapist to continue beyond the booked time and The Wizard Therapist is available to do so, and may do so provided authorization has been granted. The minimum time extension is 30 minutes. Payment must be received by us prior to the performance of the time extension.

9. PERSONAL VALUABLES

The Customer shall undertake to keep all personal effects out of sight or locked away each time before the arrival of Wizard Home Services’ representative and will not hold Wizard Home Services, its therapists or representatives responsible for any losses.

10. INDEMNITY

The Customer shall agree to release Wizard Home Services, its therapists and its staff against liability from any loss, harm, injury, illness, damage, claims, demands, actions, causes of action, costs and expenses of any nature that the Customer might have or that may hereafter accrue to him/her as a result of the services provided by Wizard Home Services.

11. GENERAL CONTRACT PROVISIONS

11.1. Currency. All amounts payable pursuant to this Agreement are expressed in and shall be paid in Singapore dollars.

11.2. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the Republic of Singapore and the parties agree to submit to the non-exclusive jurisdiction of the courts of the Republic of Singapore.

11.3. Contracts (Right of Third Parties) Act. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act, Chapter 53B of Singapore, to enforce any term of this Agreement.
