HOME CLEANING TERMS AND CONDITIONS
1. THE WEBSITE
1.1 Wizard Home Services Pte. Ltd. (“Wizard”) operates and manages an online booking platform at (the “Website”) through which a customer can book a home cleaning appointment by submitting a Booking Request. Once a Booking Request has been submitted, Wizard then matches the most suitable Cleaning Service Provider from its database (the “Database”). Once Booked Service has been completed, Wizard issues an invoice on behalf of the Cleaning Service Provider to the customer and engages the Payment Agent to collect payment of the Booked Service Fee from the customer. Once collected, the Payment Agent disburses the Booked Service Fee to the Cleaning Service Provider in accordance to the Independent Contractor Agreement.
1.2. Wizard operates the Website as an independent third party facilitator for the Cleaning Services and provides you with the platform to purchase the Cleaning Services.
1.3. Wizard is not an agent or broker for you or the Cleaning Service Provider. You enter into any transaction with a Cleaning Service Provider entirely at your own risk.
1.4. The Cleaning Service Providers are independent vendors, and are not employed by nor an agent of Wizard.
1.5. Wizard uses its best efforts to monitor the Cleaning Services offered by a Cleaning Service Provider. However, as Cleaning Service Providers act as independent contractors, Wizard does not make any representations relating to the safety, quality, condition, or description of the Cleaning Services provided by the Cleaning Service Provider. Any issues regarding safety, quality, condition or description of the Cleaning Services should be notified to Wizard, who will then pass the issue onto the Cleaning Service Provider designated to your Booking Request.
1.6. All bookings are subject to Cleaning Service Provider’s availability.
The 90-day warranty period given by Wizard does not apply to Home/Office Cleaning.
3. VALIDITY OF CLEANING PACKAGE PURCHASED
3.1. Activation. Cleaning package purchased must be activated within 60 days from the date of purchase. Any package that remain after the expiration date will be forfeited.
3.2. Expiry. All cleaning sessions in a cleaning package must be utilized within 90 days from the date of the first session utilized. Any session that remain after the expiration date will be forfeited.
4. OBLIGATIONS OF THE CLEANING SERVICE PROVIDER
4.1 Performance of Booked Services. In providing the Booked Services to the Customer, the Cleaning Service Provider undertakes to:
(a) complete the Booked Services with acceptable care and skill;
(b) take all necessary steps to avoid any loss and/or damage to the Customer’s property;
(c) deliver the Booked Services in a manner, to the greatest extent possible, which gives the desired results as agreed by the Parties;
(d) utilise the Booked Service Duration effectively and efficiently in providing the Booked Services; and
(e) deliver the Booked Services in accordance with the Booking Request.
4.2 Customer Disputes
The Customer has a twenty-four (24) hour period following the completion of the Booked Services (the “Dispute Period”) to inform Wizard if the Booked Services performed by the Cleaning Service Provider is not up to a standard reasonably required of a cleaning service provider or of any damage caused by the Cleaning Service Provider (the “Customer Dispute”). Wizard shall then inform the Cleaning Service Provider of such complaints from the Customer. In the event of a Customer Dispute, the Cleaning Service Provider agrees that it will either return to the Customer to complete or rectify the Booked Services to a reasonable standard or come to an agreement with the customer regarding an amended Booked Service Fee. No additional payment will be charged to the Customer for the performance of any rectification services in satisfaction of a Customer Dispute. The Parties agree to find a suitable time for the Cleaning Service Provider to return to the Booked Service Location and complete the Booked Services through Wizard.
5. OBLIGATIONS OF THE CUSTOMER
5.1. Obligations of the Customer. The Customer shall be responsible for each of the following:
(a) To do all things necessary to enable the Cleaning Service Provider to efficiently perform the Booked Services in accordance with the Booking Request;
(b) Depending on the cleaning package purchased, provide the Cleaning Products and Equipment;
(c) To do all things necessary to provide a safe environment for the Cleaning Service Provider to provide its services; and
(d) The Customer shall be responsible for notifying Wizard of any damage caused by the Cleaning Service Provider as soon as practicable, but in any event, within the Dispute Period following the completion of the Booked Services.
5.2. Undertakings of the Customer. The Customer undertakes to make full payment of Booked Service Fee before commencement of the Booked Services by the Cleaning Provider.
6. Changes, Cancellations and Refunds
6.1. Cancellations and Amendments by the Customer.
(a) The Customer shall be permitted to cancel and amend an Event free of charge, up to forty-eight (48) hours before the Scheduled Booking Time.
(b) If the Customer cancels or amends an Event within the forty-eight (48) hour period before the Scheduled Booking Time, the Customer agrees to be charged a cancellation fee equivalent to one hour’s worth of the Booked Service Fee to be compensated to the Cleaning Service Provider.
(c) If the Customer cancels or amends an Event within the twenty-four (24) hour period before the Scheduled Booking Time, the Customer agrees to be charged a cancellation fee equivalent to the full amount of the Booked Service Fee to be compensated to the Cleaning Service Provider.
(d) Termination of a Recurring Booking Request prior to fulfillment of the minimum number of Events will result in an Early Termination fee, derived as half of the total outstanding Booked Service Fee as at the point of cancellation.
(i) The minimum number of Events for Recurring Booking Requests will be immediately applicable upon the successful confirmation by a Cleaning Service Provider of a Booking Request.
(1) Minimum number of Events for Bi-weekly Booked Services: 5
(2) Minimum number of Events for Weekly Booked Services: 10
(ii) In event of amendments to the frequency of a Recurring Booking Request, the minimum number of Events will remain unchanged in accordance to the initial frequency selected.
(e) If the Cleaning Service Provider is unable to fulfil a confirmed Booking Request, we will attempt to find you a replacement Cleaning Service Provider. If we cannot find you an alternative Cleaning Service Provider, we will reschedule your Booking Request to a new time which suits you. If we cannot find a suitable time for you, you may cancel the Booking Request at no charge.
6.2. Cancellation of Booked Services by the Cleaning Service Provider.
(a) The Cleaning Service Provider shall be permitted to cancel and amend an Event, free of charge, up to forty-eight (48) hours before the Scheduled Booking Time.
(b) If the Cleaning Service Provider cancels or amends an Event within the forty-eight (48) hour period before the Scheduled Booking Time, the Cleaning Service Provider agrees to be charged a cancellation fee which may be compensated to the Customer at Wizard’s sole and absolute discretion in accordance to the Independent Contractor Agreement.
If the Cleaning Service Provider is unable to complete an accepted Booking Request at the Scheduled Booking Time, the Booked Service may be performed by another Cleaning Service Provider as may be assigned through the Website or offline and this Agreement shall be terminated and a new agreement will be entered into between the Customer and the replacement cleaning service provider.
Should the Customer be entitled to a refund as a result of a breach of this Agreement by the Cleaning Service Provider, such refund will be limited to the amount of the Booked Services Fee paid to the Cleaning Service Provider.
7. LIMITATION OF LIABILITY
7.1. Wizard, Wizard platform and their respective partners, employees and officers are not liable for any injury, damage or loss of revenue, loss of contract, loss of goodwill or increased cost of working, nor shall Wizard, Wizard platform and their respective partners, employees and officers be under liability whether in contract, tort or otherwise for any injury, damage, or loss whether consequential, special, indirect or otherwise arising out of or in connection with the supply of Goods or Services, even if due to the negligence of Wizard, Wizard platform and their respective partners, employees and officers.
7.2. You hereby agree to defend, fully indemnify on demand and hold harmless Wizard and/or Wizard platform from and against all liabilities, claims, expenses, damages and losses including legal fees (on an indemnity basis) Wizard and/or Wizard platform may suffer arising from any breach of these terms and conditions by you, or in connection with any act, omission, default, negligence or conduct of you, or in connection with any other liabilities arising out of your participation of the massage services arranged through Wizard and/or Wizard platform under this Agreement. This obligation to indemnify Wizard and/or Wizard platform shall survive the termination of this Agreement.
8. GENERAL CONTRACT PROVISIONS
8.1. Currency. All amounts payable pursuant to this Agreement are expressed in and shall be paid in Singapore dollars.
8.2. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the Republic of Singapore and the parties agree to submit to the non-exclusive jurisdiction of the courts of the Republic of Singapore.
8.3. Contracts (Right of Third Parties) Act. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act, Chapter 53B of Singapore, to enforce any term of this Agreement.
